Can I object to a planning application after the deadline?

What happens if you missed the 21 day consultation period, whether late objections are read, and what to do if the decision has already been made.

The short answer

Often yes, in practice. The 21 day consultation period is the window in which the council must take comments into account. Most councils will still consider a comment that arrives after the closing date but before the decision is made, particularly if it raises a material consideration not already covered. It is not a right, so treat the closing date as real and, if you have missed it, act today rather than tomorrow.

What to do if you are late

Look up the application on the council portal. If the status is still "awaiting decision" or "under consideration", submit your comment through the portal immediately and email the case officer named on the application to say a late representation has been submitted and why it matters. Keep it short and lead with the strongest material point.

If the application is going to committee

Applications called to planning committee are decided at a public meeting, and late written representations are usually accepted up to a cut-off a few days before. You can normally register to speak for three minutes. The committee date is on the portal.

If the decision has already been issued

A written objection cannot change a decision that has been made. Neighbours have no right of appeal against an approval in England. The remaining routes are narrow: asking the council to check that the development is built in accordance with the approved plans and conditions, or, in rare cases involving a legal error in the decision, judicial review within six weeks, which needs a solicitor and is expensive. For anything at that stage, a planning consultant or solicitor is the right person to speak to.

Avoiding the problem next time

Councils publish weekly lists of new applications and many offer email alerts by postcode. Curtilage shows every application currently open for comment in your council, so you can check what is near you before the deadline rather than after it.

Ready to write it? Curtilage pulls the application, shows the closing date and drafts a letter in your words that cites only policies that exist. £19 per letter.
